Special Family Law Issues – Jurisdiction, Mediation & International Matters
Jurisdictional Family Law Challenges
Sometimes the courts in British Columbia do not have jurisdiction to resolve a family law matter. These cases fall under a complex area known as conflict of laws. At Duplessis Family Law in Vancouver, we have extensive experience handling these cross-border and interprovincial disputes.
If you believe the BC Supreme Court or Provincial Court may not be able to handle your case, we invite you to consult with us. We’ll help determine which jurisdiction applies and how to proceed strategically.

Alternative Dispute Resolution Options
Many family law disputes can be resolved outside of the courtroom through Alternative Dispute Resolution (ADR) methods. These include:
- Negotiation
- Mediation
- Arbitration
- Parenting Coordination
- Collaborative Practice
The key to success in all these methods is full financial disclosure by both parties from the beginning. Withholding information often leads to distrust and escalates conflict.
Negotiation
We typically begin with negotiation, either lawyer-to-lawyer or in a four-way meeting with both clients and counsel. It’s often the least expensive and most efficient way to reach an agreement.
Mediation
In mediation, a neutral third party (the mediator) helps both sides discuss and resolve disputes. The mediator does not give legal advice or make decisions—they facilitate a fair, structured conversation.
Arbitration
Arbitration is a private, binding process where a neutral arbitrator makes decisions after hearing evidence from both parties. It’s especially useful for:
- Property division
- Spousal support
- Child support
While child custody can be arbitrated, courts still retain authority to review such decisions.
Parenting Coordination
A Parenting Coordinator helps separated parents implement parenting plans and resolve minor disputes regarding parenting time, child support, and special expenses.
Collaborative Practice
Collaborative family law involves an agreement between both parties and their lawyers to resolve all issues outside of court. This often includes:
- Mental health professionals as divorce coaches
- Child specialists
- Shared financial experts (e.g., tax advisors, estate planners)
International Child Abduction & Hague Convention Cases
International parental child abduction is one of the most stressful and time-sensitive family law emergencies. These cases are governed by the Hague Convention, an international treaty that facilitates the return of abducted children to their home countries.
At Duplessis Family Law, we have a dedicated Vancouver Hague Convention Lawyer who litigates these highly specialized cases.
